Terms of Service
Effective Date: February 9, 2026
These Terms of Service ("Terms") govern your use of the SummitView platform ("Service") operated by SummitView ("we," "us," or "our"). By accessing or using SummitView, you agree to these Terms.
1. Service Description
SummitView is a Power BI monitoring and intelligence platform that provides visibility into semantic model refreshes, usage analytics, workspace inventory, capacity utilization, data quality, and gateway monitoring. The Service includes a web dashboard and a Windows agent application.
2. Account Registration
To use SummitView, you must:
- Create an account using Microsoft Azure Active Directory (SSO)
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You are responsible for all activities under your account.
3. Free Trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required for the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.
4. Subscriptions and Payments
Pricing
- SummitView Pro: $299/month or $2,999/year (all features included, unlimited users, per tenant)
- SummitView Enterprise: Custom pricing (contact sales)
Billing
- Subscriptions are billed in advance on a monthly or annual basis
- Payment is processed securely through Stripe
- All fees are non-refundable except as required by law
Cancellation
- You may cancel your subscription at any time through the Settings page
- Cancellation takes effect at the end of the current billing period
- You retain access until the end of your paid period
5. Agent Software
Installation
The SummitView agent runs as a Windows application in your environment. You are responsible for:
- Installing and maintaining the agent on your infrastructure
- Ensuring the agent has appropriate Power BI permissions
- Granting admin consent for required API permissions
Data Collection
The agent collects only Power BI metadata as described in our Privacy Policy. The agent never accesses actual report data or business information stored in your datasets.
Updates
We may release agent updates with new features or bug fixes. You are responsible for updating the agent software.
6. AI Features (BYOK)
SummitView's AI analysis features use a Bring Your Own Key (BYOK) model:
- You provide your own API key for OpenAI or Anthropic
- Your API key is encrypted and stored securely
- AI requests are made on your behalf using your key and API quota
- We are not responsible for costs incurred with your AI provider
- AI-generated insights are informational and should not be treated as guaranteed recommendations
7. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble the Service
- Resell or redistribute the Service without authorization
- Use the Service to compete directly with SummitView
- Interfere with or disrupt the Service
8. Intellectual Property
SummitView and its content, features, and functionality are owned by SummitView and are protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.
9. Data Ownership
You retain ownership of all data you provide to SummitView. We claim no ownership over your Power BI metadata or configuration. We use your data solely to provide and improve the Service as described in our Privacy Policy.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by:
- Scheduled maintenance
- Force majeure events
- Third-party service outages (Power BI, Azure AD, Stripe)
- Your network or infrastructure issues
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the 12 months preceding the claim
- We are not responsible for Power BI service issues, data loss within your Power BI environment, or actions taken based on SummitView insights
12. Indemnification
You agree to indemnify and hold SummitView harmless from claims arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
13. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Fail to pay subscription fees
- Use the Service in a manner that harms other users or our infrastructure
Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account closure.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable rules.
